Terms & Conditions for the cashfirst.com.au game of skill competition
- Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- Entry is only open to Australian residents with a current and valid email address. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- To be eligible to enter, individuals must register their details online by visiting: www.cashfirst.com.au, following the prompts and inputting the requested details. To enter, individuals must then provide an answer in 25 words or less to the following question: "Tell us what you like or dislike about Cashfirst" and submit the fully completed competition form and agreeing to the Terms and Conditions.
- Incomplete or indecipherable entries will be deemed invalid.
- Only one entry is permitted per valid email address.
- If there is a dispute as to the identity of an entrant, the entrant will be deemed to be the person in whose name the internet account is held.
- One iPod per month will be given away.
- Promotion commences May 5, 2009. Entries close at Midnight AEDST on the last day of each calender month. Winners will be notified by email. Winners will be required to confirm their delivery address in a reply email in order to receive their prize. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on literary and creative merit. The judges' decision is final and no correspondence will be entered into.
- The best valid entry, as determined by the judges, will win an iPod 8GB, valued at RRP $199.
- If the winner of a prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
- If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
- Total prize pool value, for a 12 month period is $2,388. Prizes are not transferable or exchangeable and cannot be taken as cash.
- All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant licences the Promoter to use their entry in any media for an unlimited period for any reason including but not limited to publishing the entry on the Cashfirst website and for future promotional, marketing or publicity purposes. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
- Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
- Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking any of the prizes.
- The Promoter collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes, including sending electronic messages or telephoning the entrant, for an indefinite period, without any further reference, payment or other compensation to the entrant. Entrants' personal information may be published by the Promoter. A request to access, update or correct any information should be directed to the Promoter at their address set out below.
